Yep, The Pokemon Company is attempting to sue the leakers. However, their real names remain unknown, and they need to know them in order to progress. There's court documents written, though, and they appear to be prosecuting to the fullest extent!
Honestly, I don't have much of an opinion on this. What they did was sue-able, and they're getting sued. They deserve it, frankly.
However, its entirely possible that the leakers may just be random internet people who never signed anything about non-disclosure. In this case, they basically can't get punished, so it just depends.
