I just figured out my phone's issue.  Apparently, I have to do certain "details" to update my Straight Talk Samsung Galaxy S3.  Verizon, the phone network Straight Talk uses, won't update my phone past 4.1.2, and I saw the version you need is 4.3 or higher, so I am updating it as we speak.

Just an update if anyone cares:
         Unfortunately, I couldn't update my Andriod phone through legal means(it's a Samsung Galaxy S3 with a Straight Talk phone plan and maxed out at 4.1.2), and I don't feel like ruining a decent phone, so I had no alternative, but to buy a new phone that will work with Pokemon Go.  So, I now own an iPhone 6.  I know there will be no issues with updating the firmware since Apple has this on lockdown, and I was able to transfer my phone service from the Andriod to the iPhone.  Now I can join the fun.

I used the apk, cuz i live in europe. The pokemons are here, the gyms are now instinct, and i will make all of them instinct.
